Terms of Use

By creating an OliveVPS account or using any OliveVPS service, you agree to these Terms of Use ("Terms"). If you don't agree, don't use the service. These Terms form a legal contract between you and Olive Hosting Inc. ("OliveVPS", "we", "us").

1. Account eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By signing up, you confirm that the information you provide is accurate and that you are authorized to enter this agreement.

3. Service Level Agreement (SLA)

We guarantee 99.99% network uptime per calendar month (excluding scheduled maintenance announced 72+ hours in advance). If we miss this target, we credit your account 5% of monthly fees per 0.01% missed, capped at 100% of monthly fees.

SLA credits must be requested within 30 days of the incident via support@olivevps.com. Credits are applied to future invoices and are not redeemable for cash.

4. Billing and payment

VPS plans are billed monthly in advance. Dedicated servers are billed monthly with optional quarterly/annual discounts. Payment is due on the renewal date. Failed payments result in:

Accepted payment methods: credit/debit card, PayPal, bank transfer, and major cryptocurrencies (BTC, ETH, USDT). Cryptocurrency payments are non-refundable due to network volatility.

5. Refund policy

VPS plans carry a 7-day money-back guarantee for first-time customers. Dedicated servers carry a 24-hour satisfaction window. Refunds are issued to the original payment method within 10 business days. Setup fees, IP justification fees, and add-on services are non-refundable.

6. Data backups

Customers are responsible for maintaining their own backups. While we offer automated snapshot services on most plans, OliveVPS provides no warranty against data loss. We strongly recommend off-site backups for any production workload — including yours, even though we already learned this lesson the hard way.

7. Suspension and termination

We may suspend or terminate your account immediately for:

You may close your account at any time from the control panel. Pro-rated refunds are not provided for early cancellation outside the satisfaction window.

8. Intellectual property

You retain all rights to content you store on OliveVPS servers. We claim no ownership over your data. The OliveVPS brand, logo, control panel software, and website content are property of Olive Hosting Inc. and may not be copied without written permission.

9. Disclaimer of warranties

Services are provided "as is" and "as available" without warranties of any kind, express or implied, except as explicitly stated in our SLA. We do not warrant that services will be uninterrupted, error-free, or meet your specific requirements.

10. Limitation of liability

To the maximum extent permitted by law, OliveVPS's total liability for any claim arising from these Terms is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.

11. Indemnification

You agree to indemnify and hold OliveVPS harmless from any claim arising from your use of services, your violation of these Terms, or your violation of any third party's rights.

12. Governing law

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles. Disputes shall be resolved exclusively in the state or federal courts of Delaware. EU consumers retain the right to bring proceedings in their country of residence.

13. Changes to these Terms

We may update these Terms at any time. Material changes will be announced by email at least 30 days before taking effect. Continued use of services after the effective date constitutes acceptance.
